FORBIDDEN TO USE TIKTOK

The United States will have to resolve an appeal filed by representatives of TikTok against a law. The Chinese government could have access to the personal data of more than 170 million people who use this social network.
In the case of Mexico, the Mexican Constitution establishes freedom of expression as a fundamental right that ensures people spaces to deploy their individual autonomy, which must be respected and protected by the State itself. In addition, this article requires respect for the right of individuals not only to express their own thoughts, but also, as members of a collective, to receive information and to know the expression of the thoughts of others, which makes this right a right of public order and of social interest.
The constitutional text itself establishes as cases of exception the attack to morality, to private life or rights of third parties, that causes a crime or disturbs public order. The evidence and the rationality of the law subject to constitutional control will be important, because from there it can be seen if the State is previously censuring the exercise of this fundamental right.
However, it is a reality that the most important digital platforms have managed to concentrate millions of personal data that can be materially violated by the owners of these networks.
